Assumption of Risk, Release, and Liability Waiver

Read this document carefully. It affects your legal rights, including your right to sue and to recover damages. By booking a trip through The Huntsman Club you agree to this waiver. Individual hosts may also require you to sign their own waiver on arrival.

1. Activities covered

This waiver applies to every trip, experience, stay, lease, or activity booked or arranged through thehuntsmanclub.org (each an "Activity"), including but not limited to hunting big game, small game, waterfowl, upland birds, and predators; freshwater and saltwater fishing; archery; muzzleloader; firearm use; boating, kayaking, and canoeing; horseback riding and pack trips; use of ATVs, UTVs, and snowmobiles; hiking, camping, and backcountry travel; use of stands, blinds, and other equipment; and lodging on rural or wilderness property.

2. Assumption of risk

I understand that hunting, fishing, firearm and archery use, boating, riding, and backcountry travel are inherently dangerous. Risks include, without limitation:

• Death, serious bodily injury, drowning, hypothermia, heat illness, and animal attack.
• Gunshot, arrow, hook, blade, and other equipment injuries, including negligent discharge by me or others.
• Falls from stands, blinds, cliffs, horses, and vessels.
• Vehicle, ATV, boat, and aircraft accidents used to reach or move within the Activity area.
• Exposure to weather, wildlife, insects, allergens, and remote conditions with limited or no cellular service or medical care.
• Loss or damage to firearms, optics, tackle, vehicles, trailers, and other personal property.

I voluntarily assume all such risks, whether foreseeable or not, and whether known to me or not, arising from the Activity.

3. Firearm and equipment responsibility

I represent that I am legally permitted to possess and use the firearms, ammunition, bows, and edged tools I bring to or use on the Activity. I will follow the four rules of firearm safety at all times, will handle all equipment safely, and will comply with the host's directions and applicable law. I will not consume alcohol or impairing substances while handling a firearm or operating a vessel.

4. Licensing and legality

I represent that I hold, or will hold before the Activity begins, every license, tag, permit, and stamp required by the state and locality where the Activity occurs. I will comply with all season dates, bag limits, method restrictions, and reporting requirements. I understand that The Huntsman Club is not responsible for verifying my licenses.

5. Medical fitness

I represent that I am in good physical condition and have no medical condition that would make participation dangerous. I authorize the host and emergency personnel to provide first aid or arrange transport to a medical facility if I am unable to consent and I agree to be financially responsible for that care.

6. Release and covenant not to sue

To the fullest extent permitted by law, I release, waive, and discharge The Huntsman Club, its officers, directors, employees, agents, contractors, and affiliates (collectively, the "Released Parties") from any and all claims, demands, actions, and causes of action arising out of or related to any loss, damage, injury, or death sustained by me in connection with an Activity, including claims based on the negligence of the Released Parties, and I covenant not to sue the Released Parties for any such claim. This release does not apply to gross negligence, willful misconduct, or any claim that cannot be waived under applicable law.

7. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any claim brought by me, my family, my estate, my heirs, or any third party arising out of my participation in an Activity, my violation of law, or my breach of this waiver.

8. Minors

If I am booking on behalf of a minor, I represent that I am the minor's parent or legal guardian, and I agree to this waiver on the minor's behalf, and I release the Released Parties from claims brought by or on behalf of the minor to the fullest extent permitted by law.

9. Photography and content

The host, and other guests, may photograph or record the Activity. The host may share trophy or grip and grin photos with The Huntsman Club for use on the Platform, subject to my ability to request removal at any time by emailing privacy@thehuntsmanclub.org.

10. Host waivers

My host may require additional waivers, safety briefings, and equipment inspections on arrival. Refusing to sign a host's waiver or refusing a safety briefing may result in cancellation without refund.

11. Severability and governing law

If any provision of this waiver is held invalid, the remaining provisions remain in full force. This waiver is governed by the laws of the State of Idaho. Any dispute is subject to the dispute resolution provisions of the Terms of Service at /terms.

12. Acknowledgment

I have read this waiver, understand it, and agree to it freely. I understand that by booking a trip through The Huntsman Club I am giving up substantial legal rights, including the right to sue the Released Parties for negligence.
